Navigating the Bio-Pharma Combination Product

• The was: Pharmaceuticals (the so-named small chemicals) and Biologics (the so-named large molecules generated by living cells) operating in separate worlds.
• The is: The Bio-Pharma Combination (the so-called biochemistry macro combination) commonly referred to as Antibody-Drug Conjugates (ADCs).

The antibodies attach to a cancer cell and deposit a payload of a pharmaceutical killer directly inside the target cell. It is brilliant science—but commercially, it is similar to walking two tightropes at the same time with different foot speeds to reach the destination. If ADCs had been available a generation ago, many lives would have been saved.

The Headache (or the Migraine) and the FDA: A Pharmaceutical or a Biologic

When submitting a bio-pharma asset to the FDA, the agency decides what parameters will apply based on the determined Primary Mode of Action (PMOA).

In plain English: Which component does the heavy lifting to treat the patient?

• If the Biologic is the primary driver: The asset is routed to CBER (Center for Biologics Evaluation and Research).
• If the Chemical Drug is the primary driver: The asset is routed to CDER (Center for Drug Evaluation and Research).

While one center takes the lead, satisfying that lead center does not equate with satisfying the rules for both. Using a currently FDA-approved small-molecule drug (such as an antineoplastic) does not mean it automatically equates to being “safe and effective” when in combination with a biologic. Human evidence must convince the FDA that the specific combination is safe and effective for its intended use before it ever becomes available for the patient.

What About Foundational Patents?

This blend of IP drastically enhances the legal monopoly and underlying value of the combination. You aren't just protecting a product; you are layering a fortress:

• The Biologic Patent: Securing the specific protein or cell line.
• The Pharmaceutical Patent: Securing the chemical formulation of the payload.
• The Linker Patent: Securing the proprietary chemical bond that holds the biologic and the drug together until it reaches the target cell.
• A Specific Device for Administration: Securing the physical structure for a necessary tool or delivery system to administer the Combination.

The President’s Viewpoint

Most of us cannot walk on two tightropes simultaneously. Avoid the circus.

Find the necessary experts who are capable of standing while walking with each foot moving at different speeds and different angles, and use their expertise to move the technology safely toward the next horizon.
